MEDICAID PLANNING

Planning Mode
The more time you have before a family member enters a nursing home, the greater your options. Learn how to apply the complex rules surrounding the disqualification and “look-back” periods. We can help you decide whether an outright gift or an irrevocable trust is right for you. Learn to avoid both gift tax and income tax issues that often result from improper family gifting.

Crisis Mode
Even if your family member is already in a nursing home or about to go into one, there still may be many opportunities to preserve family assets. Our planning has achieved the following:
  • Used special "Medicaid annuities" to protect substantially more assets for the spouse living at home

  • Allowed the spouse of the Medicaid recipient to keep all of their joint assets with no "spend down"

  • Created a special trust to hold the family’s assets while permitting Medicaid qualification

  • Avoided the "pay-back" to the State of Colorado through proper titling of the residence and other real estate
Read about another technique that can protect up to $400,000 in assets, for married couples: "Allowing More Married Couples to Qualify for Medicaid"

NOTE: The above are only examples. Your specific fact situation may not permit you to achieve the same results.
