Fees

An initial Medicaid consultation with attorney Heiser lasts 1½ to 2 hours. At this meeting, attorney Heiser will review the assets and income of the elder client(s), their particular family and living situation, and all other relevant facts. Since a thorough and proper analysis with legal advice takes time to prepare, attorney Heiser will not attempt to "solve" your "problems" on the spot. Instead, you will leave our offices with a specific proposal and a flat fee quote on what it will cost for this legal advice. The fee for this initial consultation will be waived if you decide to proceed with the plan.

Once you give your approval, attorney Heiser will prepare and mail you a very detailed and Comprehensive Report analyzing and summarizing (i) your unique family and financial situation, (ii) the applicable Colorado and Federal Medicaid rules relating to gifting, penalty periods, lookback periods, treatment of income and assets, etc., and (iii) how these rules and options apply to your unique situation. Included in this customized Report will be various options for protecting both the assets of the elder client(s) and their home, and the pros and cons of a number of possible solutions to their Medicaid eligibility and asset protection issues. As a general rule, this complete Report will cost you substantially less than the cost of even a single month's stay at a local nursing home. We believe you will find this approach both beneficial and economical for the value you receive.

A follow-up meeting may or may not be needed, and is often handled over the telephone. Any deeds or other documents (such as a revised or new Will, Power of Attorney, or Living Will) are charged at a flat fee--the estimate of these costs will be given to you in advance, before any work is done.
