Important Documents for Medicaid Planning

New Will
Make sure the property owned in the name of the "community spouse" is not simply left to the nursing home spouse, which would cause immediate disqualification of the spouse! A new will is recommended, often including a Special Needs Trust for the benefit of the nursing home spouse.
Financial Power of Attorney
Appoints someone to make financial decisions for you if you are unable to do so. Without this vital document, your family will most likely be forced to petition the probate court for an expensive "conservatorship" proceeding, and many of the techniques described here will no longer be possible.
Medical Durable Power of Attorney
Appoints someone to make medical decisions for you if you are unable to do so. If new "HIPAA" language is not included, your agent may have problems getting access to your medical records!
Living Will
Provides for termination of life support if you are dying with no hope of recovery. Without this important document, your family may have to pay thousands of dollars in needless medical costs, plus endure mental anguish you hoped to avoid.
Medicaid Deed
Protects the residence of a Medicaid recipient from the State’s reimbursement claim, following the recipient’s death, for all the Medicaid benefits it paid out on the recipient’s behalf. Save your house! Be sure to ask about this technique.
