MEDICAID SERVICES
 
  • Initial Consultations

  • We will consult with you in your home, at the nursing home, or our office, to analyze your planning needs. In addition to a frank discussion of your situation, we will review your existing estate planning documents to determine whether we need to make any changes or revisions for asset conservation, Medicaid planning, or other purposes. While it is always best to do your planning in advance of needing nursing home care (Medicaid Pre-Planning), we realize that this cannot always be done. Accordingly, we also assist with Medicaid Crisis Planning.

  • Legal Documents

  • We prepare all legal documents required in your matter including, as needed: new Wills, Financial Durable Powers of Attorney, Medical Durable Powers of Attorney, Living Wills, Deeds, Qualified Income Cap Trust (“QIT”), and Irrevocable Gift Trust.

  • Determining Eligibility Status

  • We will analyze your Medicaid eligibility status and the legal services you will require to qualify for Medicaid (whether in a nursing home or community-based program). Based upon our review, we will also determine our flat fee rate for your particular matter, as appropriate.

  • Comprehensive Plan

  • When you retain us, we will prepare a comprehensive plan to restructure your assets to meet Medicaid program requirements. We provide both pre-planning and crisis planning. If asset restructuring is not required, we will begin the Medicaid application process for you.

  • Medicaid Applications

  • After implementation of the plan, when the time comes to file the Medicaid application, we will prepare and file the application, schedule the Medicaid interview, attend the interview, and present documents supporting eligibility on your behalf.

  • Complete Follow-Up

  • We follow up on the application until we obtain a decision.

  • Medicaid Hearings and Appeals

  • A small number of cases require an administrative Fair Hearing to obtain the required result. That may be due to the complexity of a matter that may not be readily approved by the Medicaid caseworker. In that limited eventuality, for a separate fee, we represent you in requesting a review or at the Fair Hearing.
     
    Working Together

    Often the individual desiring legal advice wishes to have one or more family members attend the consultations. We encourage the involvement of family members while understanding the importance of preserving the privacy of the elder client.

    We make sure each client thoroughly understands his or her documents, going through and summarizing each legal document, in plain English. We are committed to answering your questions and maintaining a relationship with you even after your initial problem is resolved.
